Paddle Board Rental Agreement and Policies

1. Service Provider:
 
Xplore Rentals LLC 
Organized under the laws of the State of California, and operating under the laws of the USA

(Hereinafter referred to as "Lessor", “we”, “us”, ”our”)
 
2. Age Requirements:
 
If you are under the age of 18, you must have your parent or legal guardian’s permission to book a paddle board session. Please have your parent or legal guardian read these terms to you. 
If you’re a parent or legal guardian, and you allow your child to book a paddle board session, then these terms apply to you and you’re responsible for your child’s activity on the service. 
 
3. Cancellation Policy:

  • Cancellation by Lessee:

    • If Lessee cancels within 24 hours of the rental start time, or is a no-show, a non-refundable fee of $10.00 may be charged to the Lessee's payment method on file.

    • Cancellations made more than 24 hours prior to the rental start time will receive a full refund

  • Cancellation by Lessor:

    • Lessor reserves the right to cancel any rental due to unsafe weather conditions (e.g., high winds, lightning, heavy rain), unforeseen equipment issues, or other circumstances beyond Lessor's control.

    • In such cases, Lessee will be offered a full refund or a credit for a future rental at their discretion. Lessor is not responsible for any other costs incurred by Lessee due to cancellation.

 
4. Renter Responsibilities:

  • Lessee agrees to use the equipment safely and responsibly, in accordance with all applicable laws, regulations, and Lessor's instructions.

  • Lessee confirms they are competent and capable of operating a paddle board in the prevailing conditions.

  • Lessee agrees to wear the provided PFD at all times while on or near the water with the paddle board.

  • Lessee will not use the equipment under the influence of alcohol or drugs.

  • Lessee will immediately notify Lessor of any damage, malfunction, or loss of equipment during the rental period.

  • Lessee will not modify or attempt to repair the equipment.

  • Lessee will adhere to all designated boundaries and safety guidelines provided by Lessor.

 
5. Damage, Loss, or Theft of Property:

  • Lessee is solely responsible for the care and condition of the rented equipment from the time of pickup/delivery until its return to Lessor.

  • Lessee agrees to return the equipment in the same condition as received, reasonable wear and tear excepted.

  • In the event of theft, Lessee will be charged for the full replacement cost of all stolen items.

  • In the event of damage to the equipment (beyond normal wear and tear), Lessee agrees to pay Lessor the full cost of repair or replacement of the damaged equipment, as determined by Lessor.

  • Specifically, for a stolen or irreparably damaged paddle board, Lessee will be charged the amount for a new paddle board.

  • Similarly, for stolen or irreparably damaged life vests and electronic pumps, Lessee will be charged the amount for new replacements.

  • Lessee authorizes Lessor to charge the credit card on file for any repair or replacement costs incurred due to damage, loss, or theft.


 
7. Accidents & Liability Waiver & Assumption of Risk:
 
Lessee acknowledges that paddleboarding involves inherent risks, dangers, and hazards, including but not limited to:

  • Changing weather conditions, currents, and tides.

  • Collisions with other watercraft, objects, or persons.

  • Falling off the paddle board and potential for drowning.

  • Exposure to sun, wind, and cold water.

  • Injury from equipment failure, improper use, or unforeseen circumstances.

  • Wildlife encounters.


Lessee freely accepts and assumes all risks, dangers, and hazards associated with the rental and use of the paddle board equipment, and the participation in paddleboarding activities.

Xplore Rentals LLC is not liable for any accidents that occur while using paddle boards.

Lessee hereby expressly waives, releases, and forever discharges Xplore Rentals LLC, its owners, employees, agents, and affiliates (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, and liabilities of any kind whatsoever, whether in law or equity, arising from or relating to any injury, death, property damage, or loss sustained by Lessee or any third party, arising out of or in connection with the rental, use, or operation of the paddle board equipment, even if caused by the negligence of the Released Parties.
 

8. Overbooking and Lessor Cancellation

In the rare event that we are unable to fulfill a confirmed rental due to unforeseen circumstances, including but not limited to equipment unavailability or overbooking, Xplore Rentals LLC reserves the right to cancel the rental. In such cases, the Lessee will be notified as soon as reasonably possible and will receive a full refund of any rental fees paid. We shall not be liable for any additional costs, expenses, or damages incurred by the Lessee as a result of such cancellation.

9. Indemnification:
 
Lessee agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with Lessee's rental, use, or operation of the paddle board equipment, including any claims brought by third parties.
 
10. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the State of California and the United States of America, without regard to its conflict of laws principles. Any disputes arising under this Agreement shall be resolved in the courts located in San Diego County, California.
 
11. Severability:
 
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
 
12. Entire Agreement:

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.

13. Changes to This Rental Agreement:

We may update this Rental Agreement from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the new Privacy Policy on this page with an updated "Effective Date." We encourage you to review this Rental Agreement  periodically for any changes.
